By ordering a commission and paying the artist, you (the client) understand and agree to the following terms:

general


  • The artist has the right to decline the commission for any reason.

  • All communication regarding the art commission will be handled on VGen or through email.

ordering and references


  • Refer to the VGen commission sheet for up to date prices and services offered.

  • The client is responsible for clearly providing the necessary information, descriptions, and references they deem the artist shouldn't forget.

  • If allowed otherwise, the artist may take his creative liberties in the commissioned artwork.

  • References that contain A.I. Generated Images are heavily discouraged and may be grounds for the artist's rejection of sale/service. The client is encouraged to look for alternatives that do not contain such content.

process, deadlines, and revisions


  • The turnaround time typically takes between 1-3 months - depending on the complexity of the concept and the amount of workload the artist has.

  • Should there be any unforseen circumstances throughout the process, the client will be notified of the delays/changes, and an extension will be discussed if it is required. Likewise, the client is also expected to inform the artist of any delays to their response time.

deadlines

  • Any deadlines issued by the client must clearly be stated to the artist and agreed upon before the agreement of the final price.

  • The artist may incur a fee for strict or rushed deadlines, depending on the complexity of the art's concept.

  • The artist will not allow deadlines below 14 days.

revisions

  • MAJOR REVISIONS: changing the pose, the mood and overall color scheme, composition, or removing a character, etc.

  • MINOR REVISIONS: color corrections, adding/subtracting visual effects or color filters, minor feature adjustments, etc.

  • Major revisions are typically free during the drafting stages of the commission. But too many revisions will incur a flat fee - depending on the complexity of the change, and the time needed to make the change.

  • Upon approval for clean up, there will be no more room for major revisions.

  • Giving feedback/asking for revisions is the client's responsibility. Thus, if the client is unresponsive within 2 days of an update, the artist will remind the client to respond. If the client does not respond within 24 hours of the reminder, the artist will move forward with the commission regardless of the lack of client input.

  • The artist is not responsible for delays to the final product caused by client unresponsiveness/delays during each revision period.

final delivery

  • Upon delivery, the client will receive the following: a full resolution of the commissioned artwork file, and a copy of the verified media version for public use.

  • The standard of the original resolution is a minimum of 2500 px in 300 DPI. While the verified media version is a minimum of 1000 px in 72 DPI. The file format will be in .PNG unless discussed otherwise.

  • Both copies will be watermarked, and the verified media features a [ COMMISSION DO NOT USE ] label.

  • Both copies will also be glazed using the Glaze/Nightshade program. (See their website for more information: https://glaze.cs.uchicago.edu/index.html  .)

  • There is no physical product upon delivery.

payments, refunds, and cancellations


  • Payments for the commissioned artwork will be made through VGen - half upfront, and half upon completion (50%/50%), or full upfront (100%).

  • If the artist is unable to continue the commission for any reason, a full refund will be issued.

  • The client has the right to cancel and receive a full or 50% refund for the commissioned work before approval of clean-up/rendering, depending on how far along the artist is in the process.

  • Refunds will not be accepted once the commissioned artwork is completed, or approved to be completed. All sales will be final at that point.

  • Note that there are non-refundable site service and processing fee charges on VGen and through the chosen payment method, so a refund will not truly be 100% or 50%.

copyright and usage


  • Commissioned artworks may be for personal usage, or commercial usage. Commercial usage will incur a flat fee increase.

  • The artist offers only Digital Commercial Usage (e.g. social media assets for promotion, album covers, e-book covers, website assets, etc.).

  • The artist, Thesren (iamthesren):

  • retains copyrights over the commissioned artwork;

  • cannot claim the Intellectual Property (IP) of the commissioned artwork;

  • cannot make further profit from the commissioned artwork unless you (the client) break any of the terms of service;

  • may upload the commissioned artwork online, portfolios, as well as in publications such as art books.

  • You, the client:

  • cannot claim the artwork as your own;

  • cannot reprodruce, sell or make profits from the artwork without explicit consent from the artist;

  • cannot remove, alter, replace, or obscure the watermark - if inevitable, tag the artist in the caption;

  • cannot use for AI (Artificial Intelligence), Machine Learning, AI/ML Training, NFT, blockchain, or any other profit platforms or purposes - such usage is strictly and completely prohibited, and will never be authorized by the artist.

  • may upload the image on your social media and websites.

  • retain the rights to Intellectual Property (IP).

Should the client break any of the terms above, all of your rights to the commissioned artwork will be voided, and you will be blacklisted from the artist's services.
